OVERVIEW

Welcome to House of JH.

The terms "House of JH", "we", "us" and "our" refer to House of JH], trading as House of JH Europe, a company registered in England and Wales under company number 17381319.

We operate this website and online store, including the information, content, features, products and services made available through it, collectively referred to as the Services.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and any other policies referenced within them, explain the terms on which you may use our Services and purchase products from us.

Please read these Terms carefully before using our website or placing an order.

By accessing our Services or placing an order, you agree to these Terms. If you do not agree with these Terms, you should not use our Services.

Nothing in these Terms limits or excludes any rights you have under applicable consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

SECTION 2 – ACCESS TO OUR WEBSITE

You may use our website only for lawful purposes.

You must not:

  • use the website fraudulently or unlawfully;
  • interfere with the security or operation of the website;
  • introduce viruses, malware or other harmful material;
  • attempt to gain unauthorised access to our systems;
  • use automated systems to scrape or extract substantial amounts of content from our website without permission; or
  • use our intellectual property in a manner not permitted by these Terms.

We may suspend or restrict access to the website where reasonably necessary for security, maintenance, suspected misuse or legal compliance.

We do not guarantee that our website will always be available without interruption or that it will always be free from errors.


SECTION 3 – ACCOUNT AND CUSTOMER INFORMATION

You may be required to provide information when creating an account, placing an order or communicating with us.

You agree that the information you provide will be accurate, complete and current.

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to prevent unauthorised access to your account.

If you believe your account has been compromised, please contact us as soon as possible.

You must be at least 18 years old or otherwise legally capable of entering into a binding contract to make a purchase through our website.


SECTION 4 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, measurements, specifications, photographs and other information displayed on our website are accurate.

Because many of our products involve fabrics, timber, stone, leather and other materials, reasonable variations may occur between individual products.

Natural materials may vary in:

  • grain;
  • texture;
  • colour;
  • pattern;
  • knots;
  • markings; and
  • other natural characteristics.

These natural variations are not necessarily defects.

Colours may also appear differently depending on your device, screen settings, lighting conditions and photographic conditions.

However, nothing in this section permits us to provide a product that is materially different from its description, agreed specification, sample or other information forming part of your contract with us.

Product measurements may be subject to reasonable manufacturing tolerances where clearly appropriate to the nature of the product.


SECTION 5 – PRODUCT AVAILABILITY

All products are subject to availability.

Some furniture may only be ordered or manufactured after you place your order.

We may withdraw or discontinue products from sale at any time. This will not affect orders that we have already accepted unless we contact you and agree an appropriate solution with you.

If a product becomes unavailable after you order it but before we accept the order, we may decline the order and refund any amount you have paid.

If we have already accepted your order and are unable to fulfil it, we will contact you and provide the remedies required under applicable law.


SECTION 6 – PLACING AN ORDER

When you place an order through our website, you are making an offer to purchase the products shown in your order.

Before submitting your order, you are responsible for reviewing:

  • the products selected;
  • quantities;
  • dimensions;
  • colours;
  • fabrics;
  • configurations;
  • delivery information;
  • contact information; and
  • any customisation options you have selected.

Our website will provide you with an opportunity to review your order before submitting it.

Receiving an automated order acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and House of JH Europe is formed when we send you confirmation that your order has been accepted or otherwise expressly confirm acceptance of the order.

We may decline an order before acceptance where, for example:

  • the product is unavailable;
  • payment cannot be authorised;
  • there is an obvious pricing or description error;
  • we cannot deliver to your location;
  • we reasonably suspect fraudulent activity; or
  • accepting the order would breach applicable law.

If we decline an order after taking payment, we will refund the relevant payment.


SECTION 7 – PRICING

Prices shown on our UK website will include applicable taxes where required by law.

Any applicable delivery charge will be displayed before you complete your purchase.

Where additional services are available, such as assembly or upgraded delivery, the price of those services will also be displayed before you agree to purchase them.

We may change our prices at any time, but price changes will not affect orders that we have already accepted unless the change is required by law or you expressly agree otherwise.


SECTION 8 – PRICING ERRORS

We take reasonable care to ensure prices are displayed correctly.

Occasionally, an obvious pricing error may occur.

If we discover an obvious pricing error before accepting your order, we may contact you to give you the option of purchasing the product at the correct price or cancelling your order.

If the error is discovered after we have accepted your order, your rights will depend on the circumstances and applicable law.

We will not use this provision to retrospectively increase an agreed price simply because our own costs have increased.


SECTION 9 – PAYMENT

Available payment methods will be displayed at checkout.

You confirm that you are authorised to use the payment method provided.

Payment may be processed by third-party payment providers. Your use of those payment services may also be subject to the provider's applicable terms.

For standard online orders, payment will normally be collected when indicated during checkout.

Where a product requires a deposit, staged payment or another payment arrangement, those conditions will be clearly communicated before you place the order.


SECTION 10 – BESPOKE AND CUSTOM-MADE PRODUCTS

Certain House of JH products may be made to a customer's individual specifications or clearly personalised.

Examples may include:

  • non-standard dimensions requested by the customer;
  • structural modifications to one of our designs;
  • one-off product designs;
  • special finishes not normally offered by House of JH;
  • materials sourced specifically at a customer's request; or
  • personalised elements created specifically for that customer.

Genuinely bespoke or personalised goods may be excluded from the statutory 14-day change-of-mind cancellation right.

However, a product is not automatically bespoke merely because it is produced after an order is placed.

For example, selecting a product from our standard collection and choosing a size, fabric, configuration or colour from our normal advertised range will not necessarily make that product bespoke for the purposes of consumer cancellation legislation.

Where an item is genuinely bespoke, this will be made clear to you before you place the order.

The bespoke-product exclusion applies only to change-of-mind cancellations. It does not affect your rights where a product is faulty, damaged, misdescribed or does not conform to the specification agreed with us.


SECTION 11 – CHANGES TO CUSTOM ORDERS

If you wish to change the specifications of a bespoke or custom order after placing it, contact us as soon as possible.

Whether we can accommodate a change will depend on the stage of procurement or production.

If we can make the requested change, we will inform you of:

  • any change to the price;
  • any change to the estimated delivery date; and
  • any other material consequences of the change.

We will obtain your agreement before proceeding with a change that increases the price.

Once materials have been ordered, cut, manufactured or otherwise committed specifically to your custom specification, certain changes may no longer be possible.

This section does not affect any statutory rights you may have.


SECTION 12 – CUSTOMER MEASUREMENTS AND SPECIFICATIONS

Where you provide us with measurements, dimensions, drawings or other specifications, you are responsible for ensuring that the information you provide is accurate.

If we manufacture or supply an item correctly according to measurements or specifications supplied or approved by you, we are not responsible for problems arising solely because those measurements or specifications were incorrect.

This does not apply where:

  • the error was caused by House of JH;
  • we measured the space ourselves and made the error;
  • our product information was inaccurate or misleading; or
  • we agreed that we would be responsible for determining the required measurements.

Where possible, we recommend checking all measurements carefully before placing a custom order.


SECTION 13 – ACCESS TO THE DELIVERY PROPERTY

Furniture can be large and may require suitable access into the delivery property.

Before ordering, you are responsible for checking that the product can reasonably pass through:

  • doorways;
  • hallways;
  • staircases;
  • lifts;
  • gates;
  • entrances; and
  • other relevant access points.

You should also consider tight corners, ceiling heights and restrictions within apartment buildings or managed properties.

The dimensions provided on our website should be used when assessing access.

If we supply materially incorrect dimensions and this causes an access issue, this section will not prevent you from exercising your legal rights.

Where delivery cannot be completed because adequate access was not available despite accurate dimensions having been provided, we may charge reasonable and proportionate costs associated with redelivery, return transport or additional services where those charges were disclosed or agreed with you.


SECTION 14 – DELIVERY

Delivery options, charges and estimated delivery periods will be displayed during checkout, on the relevant product page or otherwise communicated to you before the contract is concluded.

Because some furniture is manufactured, imported or transported specifically for an order, delivery periods may differ between products.

Where we agree a specific delivery period with you, we will make reasonable efforts to deliver within that period.

Where no other delivery period has been agreed, goods will be delivered within the period required by applicable law.

Delivery estimates may be affected by matters such as:

  • manufacturing;
  • international freight;
  • customs clearance;
  • port congestion;
  • weather;
  • transport disruption; or
  • other events outside our reasonable control.

If a significant delay occurs, we will notify you as soon as reasonably possible.

Nothing in this section removes any right you may have to cancel an order or obtain a refund where goods are not delivered within the required or agreed period.


SECTION 15 – DELIVERY APPOINTMENTS

For larger furniture items, we or our delivery partner may contact you to arrange a suitable delivery date or delivery window.

You are responsible for ensuring that an authorised person is available to receive the order at the agreed delivery location.

If we cannot complete delivery because no one is available at an agreed appointment, we may charge a reasonable redelivery fee where appropriate.

Any such fee will reflect the reasonable additional cost incurred.


SECTION 16 – DELIVERY INSPECTION

We recommend inspecting your furniture as soon as reasonably possible after delivery.

If you notice visible damage, an incorrect product or another issue, please contact us promptly so that we can investigate and resolve the matter.

Where reasonably possible, photographs or video of the issue can assist us with our assessment.

Failure to report an issue immediately at the point of delivery does not remove your statutory rights.


SECTION 17 – RISK AND OWNERSHIP

We remain responsible for the goods while they are being delivered by a carrier arranged or offered by us.

Risk in the goods will normally pass to you when you, or a person identified by you other than the carrier, takes physical possession of them.

Different rules may apply if you independently arrange a carrier that we did not offer.

Ownership of the goods will pass as provided by applicable law and the payment terms of your order.


SECTION 18 – CANCELLATIONS, RETURNS AND REFUNDS

For eligible online purchases, consumers normally have a statutory right to cancel within 14 days after receiving the goods.

House of JH Europe additionally offers a 30-day return period for eligible non-bespoke products, subject to the conditions in our Returns & Refund Policy.

Genuinely bespoke or personalised goods may be exempt from the statutory change-of-mind cancellation right.

Nothing in our Returns & Refund Policy or these Terms limits your rights in relation to faulty, damaged, misdescribed or non-conforming products.


SECTION 19 – FAULTY OR NON-CONFORMING GOODS

UK consumer law requires goods supplied to consumers to meet certain standards.

Among other things, goods must:

  • be of satisfactory quality;
  • be fit for a particular purpose where applicable; and
  • match their description.

Where goods fail to meet applicable legal requirements, you may have rights to remedies including:

  • rejection and refund;
  • repair;
  • replacement;
  • price reduction; or
  • a final right to reject,
  • depending on the circumstances and applicable law.

Nothing in these Terms or any House of JH warranty restricts those rights.


SECTION 20 – WARRANTIES

Certain House of JH products may be supplied with an additional manufacturer's or commercial warranty.

Any commercial warranty is provided in addition to your statutory consumer rights.

The expiry of a commercial warranty does not automatically mean that you have no legal rights in relation to a product.

Warranty exclusions relating to misuse, accidental damage, abnormal use or ordinary wear and tear do not restrict any rights that cannot legally be excluded.


SECTION 21 – NATURAL WEAR AND PRODUCT CARE

Furniture will naturally show signs of use over time.

Normal wear and tear is not ordinarily considered a manufacturing defect.

Customers should follow any reasonable care and maintenance instructions supplied with the product.

Damage caused by misuse, accidents, failure to follow reasonable care instructions or unauthorised alterations may not be covered by an additional commercial warranty.

This does not affect your statutory rights where the product itself was faulty or non-conforming.


SECTION 22 – PROMOTIONS AND DISCOUNTS

We may offer discounts, promotional codes, bundles or other promotions from time to time.

Additional terms may apply to individual promotions and will be communicated with the promotion.

Unless stated otherwise:

  • promotions cannot be exchanged for cash;
  • promotional codes may be subject to stated expiry dates;
  • promotions may apply only to selected products; and
  • multiple promotional codes may not be combined.
  • Any promotional restriction will not affect statutory consumer rights.

Products bought during a sale or promotion retain the same statutory rights in relation to faulty or misdescribed goods as products purchased at full price.


SECTION 23 – INTELLECTUAL PROPERTY

Unless otherwise stated, the content available through our Services, including:

  • House of JH branding;
  • logos;
  • product names;
  • photographs;
  • videos;
  • graphics;
  • written content;
  • designs; and
  • website content,

is owned by or licensed to House of JH Europe and is protected by applicable intellectual property laws.

You may access and use our website for your own personal and non-commercial purposes.

You may not reproduce, distribute, sell, commercially exploit or materially modify our protected content without permission, except where permitted by law.


SECTION 24 – THIRD-PARTY SERVICES AND LINKS

Our Services may contain links to or functionality provided by third parties.

These may include payment providers, delivery providers, social-media platforms and other service providers.

Where you choose to use a third-party service, separate terms and privacy policies may apply.

We are not responsible for the content or services of independent third-party websites that we do not control.

However, we do not use this clause to exclude responsibility that we have under law for subcontractors or service providers used by us to perform our obligations to you.


SECTION 25 – SHOPIFY

Our online store is hosted and supported by Shopify.

Shopify provides the ecommerce technology that enables us to operate the online store.

Your contract for the purchase of House of JH products is with House of JH Europe, not Shopify.

Shopify may separately process information relating to your use of the store as explained in the applicable privacy policies.


SECTION 26 – PRIVACY

Our collection and processing of personal information is governed by our Privacy Policy:

Certain information may also be processed by Shopify and other service providers that assist us in operating our store, processing payments, fulfilling orders or providing our Services.


SECTION 27 – REVIEWS, PHOTOGRAPHS AND CUSTOMER CONTENT

If you voluntarily submit a product review, photograph, video or other content to us for publication, you confirm that you have the right to provide that material.

Where you give us permission to publish the material, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it for purposes reasonably connected with operating and promoting House of JH.

You retain ownership of your original content.

We may moderate or remove content that is unlawful, abusive, fraudulent, infringes another person's rights or is otherwise inappropriate for publication.

We will not require customers to surrender ownership of their content merely because they submit a review.


SECTION 28 – ERRORS AND WEBSITE INFORMATION

We make reasonable efforts to keep information on our website accurate and up to date.

Occasionally, information may contain typographical errors, omissions or inaccuracies.

Where we discover an error, we may correct the website.

Changes to website information will not automatically change a contract that has already been concluded with you.

Any changes to an existing order will be dealt with in accordance with these Terms and applicable law.


SECTION 29 – PROHIBITED USE

You must not use the Services:

  • for unlawful purposes;
  • to infringe the rights of another person;
  • to submit fraudulent orders;
  • to transmit malicious code;
  • to obtain unauthorised access to our systems;
  • to impersonate another person;
  • to collect personal information unlawfully;
  • to interfere with the operation or security of the Services; or
  • to engage in conduct that materially disrupts another person's use of the Services.

We may take reasonable action, including restricting access, where these requirements are breached.


SECTION 30 – EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for failure or delay caused by an event genuinely outside our reasonable control where we have taken reasonable steps to minimise the effect of that event.

Examples may include severe weather, natural disasters, industrial disputes, major transport disruption, war, civil unrest, government restrictions or significant infrastructure failures.

Where such an event affects your order, we will contact you as soon as reasonably practicable.

If the event causes substantial delay or prevents us from fulfilling the contract, you may have the right to terminate the affected order and receive an appropriate refund.

This section does not remove any rights that cannot legally be excluded.


SECTION 31 – OUR RESPONSIBILITY TO YOU

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase products as a consumer, we supply them for private and domestic use unless otherwise agreed.

We will not attempt to exclude or limit liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory rights concerning goods;
  • liability that cannot be excluded under the Consumer Rights Act 2015; or
  • any other liability that cannot lawfully be excluded.

SECTION 32 – BUSINESS PURCHASES

If you purchase products wholly or mainly for business, trade, craft or professional purposes, you may not qualify as a consumer for the purposes of certain UK consumer protection legislation.

Different legal rights may therefore apply to business purchases.

Where necessary, separate business or trade terms may apply to commercial orders and will be made available before the relevant contract is concluded.


SECTION 33 – COMPLAINTS

If you are unhappy with your order or our service, please contact us so that we can try to resolve the issue.

Nothing in this complaints process prevents you from exercising any legal rights or remedies available to you.


SECTION 34 – SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue in effect.


SECTION 35 – WAIVER

If we do not immediately exercise a right available to us under these Terms, this does not mean that we have waived that right.

Similarly, a delay in enforcing a provision does not prevent us from enforcing it later.


SECTION 36 – TRANSFER OF OUR RIGHTS

We may transfer our rights and obligations under these Terms to another organisation, for example as part of a sale or restructuring of our business.

We will only do so where the transfer does not materially reduce your rights under the contract.

Where required, we will notify you of such a transfer.

You may transfer your rights under these Terms where permitted by law or with our written agreement.


SECTION 37 – THIRD-PARTY RIGHTS

Unless expressly stated otherwise, these Terms are between you and House of JH Europe.

No other person has a right to enforce these Terms except where applicable law provides otherwise.


SECTION 38 – GOVERNING LAW AND JURISDICTION

These Terms and contracts between House of JH Europe and customers are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in your country of residence.

If you are a consumer resident in England or Wales, proceedings may be brought in the courts of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you may also have the right to bring proceedings in your local courts.

If we sell to consumers in another country, including a country within the European Union, nothing in these Terms deprives that consumer of mandatory protections or jurisdictional rights available under applicable law.


SECTION 39 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to:

  • applicable law;
  • our business;
  • our Services; or
  • the way our website operates.

The Terms that apply to your purchase will generally be the Terms in force when the relevant contract is formed.

We will not retrospectively change an existing consumer contract simply by publishing new Terms on our website.

The latest version of these Terms will always be available on this page.
